In Texas Business Court, LPHS Gains Injunction in Noncompete Dispute

Judge Brian Stagner of the Texas Business Court for the Eighth Division has issued a temporary injunction in favor of an LPHS client, finding that a noncompete agreement between the company and a former executive was enforceable and supported by the facts. The executive had moved from a senior leadership role at the company into the CEO role of a direct competitor, operating in the same product segment. That role “falls within the scope of activity prohibited,” the court found. “The PCA is likely enforceable… because it was ancillary to an otherwise enforceable agreement and contains reasonable limitations as to time, geographic scope, and activity.”
