Removal to Federal Court After the November 2018 Elections

LPCH partner David Coale and associate Paulette Miniter co-authored the article, "Removal to Federal Court After the November 2018 Elections: More Incentive, But Less Receptiveness" in Texas Lawbook. The article questions how the swing of Texas' big courts of appeals to Democratic majorities could lead to more removals from state to federal court.

The article states, "The Fifth Circuit should have ample opportunity to consider just how removal-friendly the federal courts in Texas will be as a matter of law. That Republican presidents appointed most of the Fifth Circuit's judges, however, does not mean it is necessarily easy to predict where that law will end up."
