LPHS appellate attorney David Coale spoke with Fox4 News on the U.S. Supreme Court’s decision to allow emergency access to abortion in the state of Idaho, returning the matter to the district court for further deliberations. As he notes, the Court’s finding that the matter arrived before the justices prematurely “is not something they do very often.”

“It turned out to be a lot more nuanced and complicated than they thought it was. There’s going to be more litigation in Idaho federal court and the Ninth Circuit, and perhaps at the Supreme Court in another year.”
