In his most recent commentary for The Dallas Morning News, LPHS attorney David Coale suggests that Texas is unlikely to follow Alabama in applying a wrongful death statute to frozen embryos in IVF clinics. He points to disparities between the two states in their constitutions and wrongful death laws as the primary reasons.

Mr. Coale writes, “At the present time, no authority supports reading the Texas wrongful death statute in the way that the Alabama Supreme Court recently read that state’s wrongful death statute. Discussion about the recent Alabama ruling should bear that reality in mind.”
