LPHS Gains Major Win in the Texas Business Courts

An LPHS team led by Eric Pinker has obtained a full summary judgment dismissal of a large, complicated claim in the Texas Business Court First Division. The case involved allegations of fraud, breach of fiduciary duty, negligent misrepresentation, and conspiracy brought by three individual plaintiffs seeking $32 million from the sale of a business in which they held an interest.

The LPHS attorneys secured multiple favorable motions for summary judgment on specific legal issues through the course of litigation – including a lack of competent damage evidence and limitations as well as the untimely designation of a “non-retained expert” – along with broader motions filed by corporate co-defendants.

“The case was complicated in multiple ways,” says Eric. “But like all big wins we had a great team – Yaman and Jessie ran the case on a daily basis, and both argued and won key MSJs, along with various other motions along the way as we systematically dismantled the opposition’s claims.”
