David Coale on Marathon Petroleum Lawsuit Against BP Over Refinery

Marathon Petroleum is suing BP over claims the energy company left its Texas City refinery in poor condition when it sold for $2.4 billion four years ago. The lawsuit alleges BP failed to “perform critical maintenance and repair work” and didn’t leave the refinery in compliance with environmental and federal regulations. In an interview with the Houston Chronicle, Lynn Pinker Cox & Hurst partner David Coale calls the timing of the lawsuit noteworthy because of the statute of limitations that expires early next year.

“There's a lot of money involved, so this isn't incredibly unusual," said Coale, who is not involved in the case. "It's a dangerous business and a heavily regulated business. Environmental regulations are complicated and reasonable minds can disagree.”
