LPCH partner David Coale and associate John Adams recently wrote an article in The Texas Lawbook titled, "Will the 2018 Judicial Elections Breathe New Life into Factual Sufficiency Review?" The article questions whether the newly elected judges on courts of appeals will find themselves at odds with the conservative Texas Supreme Court.

Coale and Adams state, "One way that new friction between the courts of appeals and the Texas Supreme Court may manifest is through a revitalized distinction between factual and legal sufficiency. In particular, courts of appeals may emphasize factual sufficiency to limit the Supreme Court’s review."
