Mary Nix and Holly Stubbs Defend Charter School, Texans Can Academy

Texans Can Academy – a charter school that provides top-quality education to at-risk kids – was sued by a disgruntled former employee for age, race and gender discrimination and retaliation. LPHS – led by partner Mary Nix – defended Texans Can leading to the full dismissal of all claims in the suit. LPHS was able to show that Texans Can dismissed the plaintiff only after four poor performance reviews in a row. In a challenging deposition, attorney Holly Stubbs was able to get the plaintiff to acknowledge that she had no information to challenge that her dismissal was not based on her poor performance or that her dismissal was in retaliation for a claim of discrimination. After a series of motions, which included three partial motions to dismiss and a motion for summary judgment, the case was dismissed in its entirety.
