LPHS Representing OpenAI in iPhone Integration Dispute with Musk-owned X

The firm is currently engaged in significant antitrust litigation brought by the X social media platform seeking to block the integration of ChatGPT as an optional add-on for several applications on its latest iPhone models. In a case filed in the Northern District of Texas, LPHS is representing OpenAI, which is seeking to dismiss the case brought by X's billionaire owner Elon Musk in an effort to gain an advantage for his rival artificial intelligence company xAI and its Grok chatbot. As reported by Law360, a key contention in the case is that the deal between Apple and OpenAI is "exclusive" and prohibits integrating iPhones with other generative AI chatbots, but Apple has said in court filings said the deal is "expressly not exclusive" and that it has plans to partner with other chatbots in the future. The firm’s Michael K. HurstChris Patton and Andy Kim are serving as co-counsel for OpenAI with the firm of Wachtell Lipton Rosen & Katz.
