LPHS Defeats Injunction Request in Trademark Licensing Dispute

An LPHS legal team representing concrete and building materials company Oldcastle defeated a temporary injunction request sought by its largest competitor: Quikrete. 

Quikrete sued Oldcastle over a trademark license when Oldcastle announced it would transition from using a Quikrete (successor to the trademark) owned trademark to a different brand for sales to Oldcastle’s customers. After the LPHS team pursued expedited discovery on a very compressed timeline and presented Oldcastle’s case at a September 9 evidentiary hearing, the court denied Quikrete’s request for a temporary injunction in its entirety.  The legal team consisting of partners Alan Dabdoub and Britta Stanton, associate Joshua Lang and paralegal Whitney Gillaspie represented OldCastle in the dispute.
