In an opinion column for The Dallas Morning News, LPHS attorney David Coale discusses the inconsistencies and lack of clarity presented by the Fifth Circuit Court of Appeals and the United States Supreme Court.

According to Coale, the relationship between the two courts has continued to fray on fundamental issues.

“American judicial bodies are independent by design. But when two of the most powerful courts in the land consistently disagree on a basic issue about judicial power, it creates confusion and deserves a second look.”
