The U.S. Supreme Court ruled 6-3 against President Biden’s vaccine mandate for larger, private businesses and the testing requirement, while allowing the mandate to stand for facilities that accept Medicaid or Medicare.

LPHS appellate partner David Coale explains what the ruling means.

“OSHA is charged by Congress with regulating workplace safety. And COVID is a problem that goes beyond workplace safety. It’s a general, public health care issue. And the Supreme Court, the majority of it said, look you just don’t have power there. You are not a national health agency.”
