Texas Cases to Watch in 2019

LPCH partner David Coale comments in Law360's "Texas Cases to Watch in 2019" saying the opioid MDL is a case worth watching not just because of the specific issues that litigation will address, but also because it could "provide insights on how courts are supposed to work on these big, profound social issues." In 2018, the Texas Judicial Panel on Multidistrict Litigation consolidated 16 cases alleging that opioid makers and distributors made false and misleading statements about the drugs.

“It's obviously very important socially. ... and involves a big issue in its own right,” he said. “It's kind of like the tobacco litigation in how do you use the courts to deal with something so big, that involves so many companies? There's a big problem with addiction, and this tests the limits of the courts — these really big mass torts.”
