A federal judge in Texas has blocked a Federal Trade Commission rule that would have banned companies from using noncompete clauses in employment agreements, ruling the agency does not have the authority to enforce such a broad-based prohibition. In an interview with Fox4 News, LPHS partner David Coale analyzed the ruling, in which the court called the ban an “overreach”:

“This sort of argument that she adopts in this case about FTC going beyond its statutory authority is very popular these days in the courts."
