Appellate Partner David Coale Discusses Texas AG, US Representative Lawsuit Against CDC Over Masks

Texas Attorney General Ken Paxton and U.S. Representative Beth Van Duyne filed a lawsuit against the Centers for Disease Control to remove mask requirements on planes and other transportation. The case has the potential to go to the U. S. Supreme Court. LPHS appellate partner David Coale explains the argument. “The argument here is that the CDC has certain powers given by federal law, given by Congress to it, and what it has done in the area of airport safety and specifically with mask requirements goes beyond those boundaries.”
