In a hotly contested arbitration, an LPHS team of John Volney and Chelsea A. Till secured a major win for Green Brick Partners in a case involving the interpretation of a contractual deadline for the real estate developer to submit a request for reimbursement for cost overruns in the development of a residential subdivision. 

The opposing party contended that the reimbursement request was submitted one day late, and as a result Green Brick had forfeited the right to any reimbursement. The arbitrator rejected that argument and awarded $1.359 million in damages, $330,000 in attorneys’ fees, expenses, and pre- and post-judgment interest, making the total expected award slightly more than $1.8 million.

“Chelsea’s cross of the opposition’s land development expert, coupled with the testimony she got from Green Brick’s VP of Finance was central to the arbitration award,” says John.
