LPHS Secures $1.8 Million Arbitration Win in Contract Dispute

LPHS’s team of John Volney and Chelsea A. Till recently secured victory in an arbitration where LPHS’s client sought more than $1 million in cost overruns incurred in developing a North Texas residential subdivision. 

The opposing party argued that the reimbursement request was one day too late and that, as a result, LPHS’s client had forfeited its right to any reimbursement under the parties’ contract.

The arbitrator rejected that argument and awarded 100% of damages sought by LPHS’s client, including attorneys’ fees, expenses, and pre- and post-judgment interest, making the total arbitration award slightly more than $1.8 million in favor of LPHS’s client.

“Chelsea’s cross of the opposition’s land development expert and the testimony she got from our client’s VP of Finance were central to the arbitration award,” says John.
