In response to the American Tort Reform Association's critical depiction of the Fifth District Court of Appeals, LPHS appellate attorney David Coale recently defended the court in a rebuttal published in the Dallas Morning News that has earned recognition in Texas Lawyer.

"From the perspective of the state's top civil court, the Fifth Court is, almost literally, the 'middle of the road," said Mr. Coale. "The timing of this, I assume, has something to do with the election cycle. But I don't know what it has to do with any broader strategy. I didn't see a lot of statistical analysis [in the report]. I saw a series of cases that they thought was problematic."
