Multi-Million Dollar Jury Verdict Win for Herff Jones in Trade Secret Trial Against Jostens Inc.

LPCH attorneys Michael K. Hurst, Andres Correa, and John Adams successfully represented Herff Jones, the leading provider of class rings, yearbooks and graduation gowns, in a trial against top competitor, Jostens Inc.

Two sales representatives who worked for Herff Jones distributor, Brent Gilbert and his company GradPro Recognition Products, were accused of sharing trade secrets about Herff Jones pricing, commission structures, and strategies and steering accounts away from Herff Jones to Jostens Inc.

The jury found for Gilbert and Herff Jones on Herff Jones's claims that Jostens “conspired and stole confidential and trade secret information, and interfered with Herff Jones’ contracts with its sales representatives.”

The unanimous jury verdict ordered that Jostens and the two sales representatives pay nearly $1.9 million in compensatory damages to Herff Jone, another $580,000 in compensatory damages to Brent Gilbert of GradPro, and another $680,000 in punitive damages against Jostens and the sales representatives.
