Last June, Texas officials deployed buoys in the Rio Grande in an effort to deter illegal border crossings near Eagle Pass. While the federal government initially won the lawsuit before a Fifth Circuit panel to have the buoys removed, the state successfully sought a ruling to have the entire 17-judge court review the case. LPHS attorney David Coale spoke with Fox 4’s Alex Boyer to discuss the latest developments.

"It seems that a majority of the [Fifth Circuit] may or may not think the panel is wrong, but they certainly have some serious questions about how the panel got there on this question of federal versus state authority of the border, and they want to thoroughly air it out," Mr. Coale said. "So, it's going to get a lot of scrutiny in May when this goes before the full 5th Circuit."
