Fox 4: Coale Analyzes Judicial Arguments in Abortion Law, Book Ban Challenges

LPHS attorney David Coale recently provided his expertise regarding two controversial hearings before state and federal appellate panels. The first case involved the 5th Circuit’s review of a new Texas law that seeks to regulate the content of books distributed to public school districts.

"One of the goals is to avoid minors coming into contact with sexually explicit material, and so that's the stated goal," Coale explained. "The challenge to it is that this is something that we really disfavor under the First Amendment to our Constitution."

The second interview covered a Texas Supreme Court hearing on challenges to the state’s restrictive law on abortions, with plaintiffs arguing that due to the statute's vague language, they were denied needed health care for their medically complex pregnancies. In that Fox 4 interview David said he anticipates the conservative justices will have a pre-disposition to side with the state, but that the plaintiffs presented a strong argument.
