Firm Secures $2.8 Million Arbitration Win in Breach of Contract Claim

Following a four-day arbitration, the LPHS team of Jonathan R. Childers and Farsheed Forsouni secured $2.845 million in damages in a breach of contract claim on behalf of EBizCharge, a large, privately-held Independent Sales Organization. EBizCharge’s suit alleged that Global Payments Inc. and two of its affiliates wrongfully withheld credit voucher interchange when consumer transactions were refunded, in violation of the parties’ written agreement. Such payment processing funds are used throughout the merchant services industry to facilitate credit transactions. The award includes more than $2 million in direct damages, as well as interest, attorney fees and arbitration costs. The LPHS team was ably assisted by co-counsel Dan Fuller of Cadden & Fuller in Irvine, Calif. The arbitration award was subsequently confirmed by the Northern District of Texas.
