Firm Gains Appellate Win for Dallas Contractor in Restaurant Dispute

LPHS partner Greg Brassfield, with associate Dan Polese, secured a notable appellate court victory for a Dallas contractor seeking to recover expenses for construction of a local fast-food restaurant. The Fifth Circuit court reinstated a $117,182 verdict against the defendant, finding that the jury’s rationale for the award was sound despite a reversal of the verdict by the trial court. "We are obviously pleased that the Dallas Court of Appeals correctly applied longstanding law that substance of whether construction costs were 'reasonable and necessary,' and not magic words, carries the day," Greg said in a Law360 interview about the court’s ruling. That ruling also remanding the case to the trial court for the limited determination of attorney’s fees and associated interest.
