As U.S. Senators prepare for a second impeachment trial of former President Trump for inciting in January 6 insurrection, LPHS appellate partner and constitutional law expert David Coale discusses what the Constitution allows in the matter, including a challenge from the former president in federal court and the U.S. Supreme Court if convicted.

“I doubt the courts will be that interested, but it’s a possibility. There is some reason why they might be interested. Or if he were convicted, like any criminal type proceeding and the court system, he could challenge that in court, saying this was not appropriate, this Senate lacked jurisdiction over me.”
