David Coale on a "Procedural Advantage" in the Ken Paxton Impeachment Trial

In a recent interview with the local CBS affiliate, LPHS attorney David Coale was interviewed by CBS11 to explain why Ken Paxton's wife, State Senator Angela Paxton, would not be an active juror in his impeachment trial. Legislators drafted 31 rules for the trial after a two-day closed session, with one of the rules barring her from participating. Senator Paxton will still be required to be on the Senate floor during the impeachment trial.

"She is not allowed to vote on any matter, so not just the ultimate vote, but any procedural point that comes up along the way," Coale said. "She is not allowed to participate in closed sessions where they have deliberation either about the ultimate verdict or about some other issue. So, the higher threshold, the harder it gets, and sometimes one vote is all the difference in the case. So, it ends up with a slight procedural advantage for the Attorney General."
