David Coale Explains Court Rulings in Texas Debate on Mask Order

In an effort to protect the public from COVID-19, some Texas county, city and school leaders are challenging Gov. Greg Abbott’s order that bans mask mandates. The Texas Supreme Court ruled in favor of the governor’s order, but the issue is not over. Hearings are scheduled as a next step in the injunction process, in which the trial courts will receive additional evidence from public health officials. LPHS appellate partner David Coale:

“The thrust of it is, if you are a county, you are trying to say - I get to keep certain rulemaking authority, the governor can’t take it all away from me - and so to prove the case to make that claim you gotta bring in someone that shows why you’ve got a real problem in your county.”
