David Coale Discusses Supreme Court Ruling on Immigrant Case

The U.S. Supreme Court recently ruled in favor of an undocumented immigrant fighting deportation. LPHS appellate partner David Coale explains the notice discussed in the case and the letter in the ruling on KLIF News & Information in the Morning.

“The temptation in what led to this case is to kind of dribble it out. You send a first notice to stop the clock, to turn off the 10-year time period and then you send more notices particularly when the immigration courts are jammed up and it’s not entirely clear what date and time it might be. Justice Gorsuch writing for a majority says, uh-uh, it says one notice, you get one package. Which means that the clock stops, and the hearing is set, and everything goes to that one time, so it is a fascinating connection of a lot of things in practice in this area and it all hinges on the word A, cause the law says A notice.”
