David Coale Column in Dallas Morning News Addresses 5th Circuit’s “Original Intent” Rulings

In an op-ed column published by The Dallas Morning News, LPHS attorney David Coale writes that recent 5th Circuit rulings that rely heavily on the “original intent” of the Constitution’s framers raise serious questions about how that focus will continue to reshape the country. Guided by that standard, on Feb. 2 the Court held the federal ban of possession of a firearm by a person under a domestic violence restraining order to be unconstitutional. “It is not surprising that the historical record, from a time when women could not vote or own property, had little to offer about modern domestic-violence law. That era also has nothing to offer about how to change a light bulb or administer antibiotics,” David writes.
