Coale’s Commentary Questions AG’s Appeal in State Fair’s Gun Dispute

In a column for The Dallas Morning News, the firm’s David Coale raises concerns about Texas Attorney General Ken Paxton’s filing an appeal in the state’s new business court system over the ban of firearms at the upcoming State Fair. A state district court denied the AG’s motion for a temporary injunction against the Fair and City of Dallas to halt the ban.

“While this appeal may be in the new court’s jurisdiction, it is not the type of case it was meant to handle,” Coale writes. “Paxton’s decision to bring this politically charged and legally questionable case to this new court undermines its intended purpose and interferes with a successful start to its operations.”

Following the appellate court’s denial of the request, Coale commented on the AG’s possible next steps in a Fox4 interview: “For present purposes, the Fair is good to go. And the only question is whether Mr. Paxton can get our state Supreme Court interested.”
