Chris Schwegmann Comments on Use of AI in Trial Preparation in Texas Lawyer
Law firms are beginning to use artificial intelligence platforms in pre-trial preparations, including focus group testing, jury selection guidance, cross-examination preparation, opening statement rehearsal, and determining the most effective visuals. In a recent article in Texas Lawyer, LPHS managing partner Chris Schwegmann discusses how the firm is using Harvey, a closed legal AI system built on ChatGPT and now integrated with Claude. To prepare for court, Chris has Harvey assume opposing counsel's role to identify weaknesses, generate counterarguments, and anticipate the other side's opening statements, often revealing points he hadn't considered.
"If it comes up with 10 points, I will have anticipated seven of them," Schwegmann said. "But I'm always surprised by two or three things that reveal some kind of hole or issue with my case. As our clients start adopting these tools themselves internally ... unless lawyers start to use them too, they're going to get left behind."
