David Coale and John Adams Discuss “Goldilocks” Issues in The Appellate Advocate

LPCH partner David Coale and associate John Adams discuss the importance of “Goldilocks” issues in the Appellate Section of the State Bar of Texas. The two suggest that by focusing on “Goldilocks” issues, the Dallas court would have the most lasting impact with its en banc cases. “The court’s position as an intermediate court,” they write, “forces en banc review to play a specific and limited role.” The cases that are “just right” involve substantive issues, but not issues with such ramifications that the Texas Supreme Court will immediately opine on the same issues.
