Chris Schwegmann Comments on Buc-ee’s Trademark Win in Law360
Texas jurors recently sided with convenience store chain Buc-ee’s in a trademark infringement fight over its beaver logo. The jurors gave Buc-ee’s an across-the-board victory after hearing evidence that Choke Canyon, a rival convenience store, intended to copy various similarities of Buc-ee’s logo.
LPCH partner Chris Schwegmann comments on the case in a Law360 article, claiming that the logo similarities are not unlawful. “Here’s the problem,” he said. “It’s not unlawful to compete. Intent to compete is not the same as intent to confuse.
