David Coale, partner at Lynn Pinker Cox & Hurst, comments in Law360's article, "5th Circuit Allows Part of TX Sanctuary Ban to Take Effect," which discusses Texas' anti-sanctuary city law, a federal immigrant detainer program that enlists the assistance of local law enforcement.
Coale comments, "Though the government clarified in its Fifth Circuit brief that S.B. 4 does not aim to prohibit facially neutral policies, municipalities may still face some liability if the effect of their policy is to “completely foreclose” cooperation with immigration authorities."
"Also in Monday’s decision, the appeals court stayed an injunction with regard to a provision that precludes cities and counties from outright prohibiting public employees from providing enforcement assistance to federal authorities. As an example, locals could not instruct local law enforcement not to return phone calls from ICE, Coale said."
