David Coale Comments on "Sharply Divided 5th Circuit Rejects J&J’s Mandamus Request in Hip Implant MDL"
The U.S. Court of Appeals for the Fifth Circuit refused to intervene in the large Johnson & Johnson hip implant multidistrict litigation cases that have been consolidated in federal court in Dallas. Last Thursday, a panel rejected the J&J's petition for mandamus and also refused to stop the U.S. District Judge, Ed Kinkeade, from moving forward with trial plans. David Coale, partner at Lynn Pinker Cox & Hurst, has followed then J&J case and said it was clear from the oral argument last week that Judge Smith could be the “swing” vote.
