David's Law Could Offer Balancing Act for Schools, Chance for More Education
David's Law, one of the first pieces of legislation filed for the 2017 state legislative session, aims to prevent and combat cyberbullying by giving school districts and law enforcement more authority in handling these cases. In a bylined article published in Texas Lawyer, Lynn Pinker Cox & Hurst partner Shonn Brown notes that existing Texas laws provide protections against such acts, but those laws often have not provided specific interventions to prevent targeting another person through technology. “Schools need direction on discreetly managing these events before bullying becomes a criminal act, and the permanent ramifications that come with criminal charges,” she writes. “In an effort to keep up with the digital evolution, schools need policies that are proactive instead of reactive, finding the balance between the victim's rights and protection of freedom of speech.” Read the entire article here.
