Commercial and Business Litigation
Mr. Fielding is an energetic advocate for his clients with litigation experience unique among his peers. He has broad experience with complex commercial litigation, having successfully represented both plaintiffs and defendants in state and federal courts and in matters ranging from complex energy litigation to intellectual property disputes. He has also represented parties on appeal in state and federal appellate courts, including before the United States Court of Appeals for the Federal Circuit.
Mr. Fielding's work for his clients has involved all aspects of litigation, having drafted, argued, and won several dispositive motions, taken and defended numerous depositions, including depositions of key expert witnesses, and tried a case to a verdict.
Representative Trials and cases:
In late 2006, Mr. Fielding won a take-nothing jury verdict in one of the nation's first nuisance lawsuits against a wind energy development. After a two-week trial, jurors in the case found that the Juno Beach, Fla. based FPL Energy LLC did not create a private nuisance when it constructed the Horse Hollow Wind Energy Center, the world's largest wind farm. Mr. Fielding had extensive responsibilities in that case, deposing over seventy witnesses, including the plaintiffs' key engineering and valuation experts, briefing, arguing, and winning a key motion disposing of plaintiffs' primary claims, and successfully trying the case to the jury.
Education and Legal Experience
Mr. Fielding earned his J.D. from Harvard Law School in 2003, where he was Executive Editor of the Harvard Journal of Law and Public Policy. Prior to attending law school, he attended Brigham Young University, graduating in 2000. Before joining the firm in 2005, Mr. Fielding worked as a law clerk to the Honorable E. Grady Jolly of the Fifth Circuit Court of Appeals. He also practiced law in the Dallas office of Baker Botts. Mr. Fielding is licensed in Texas, and is admitted to practice before the Fifth Circuit and Federal Circuit Court of Appeals and the Northern and Eastern Districts of Texas.
Personal Background
Born in Pasco, Washington, as the first of seven children, Mr. Fielding grew up on a potato and hay farm, where he was raised on a steady diet of digging ditches, milking cows, and weeding fields. Following high school, Mr. Fielding served a two-year mission for his church in East Africa, learning to speak fluent Swahili and cook up a mean batch of rice and beans. Mr. Fielding and his wife, Laura, will celebrate their ten-year wedding anniversary in the spring. They are the proud parents to three sons - Alex, Aidan, and Avery - and one daughter, Maddie.
